In reality, Heroes is a game where luck plays a significant role. This includes everything from the map, starting army, resources, guards, blockades, heroes, leveling up of support units, building the Guildhall, computer opponents, and how the game unfolds. Although, class does matter in most cases.
In the last game, I had Galtran with 6lm10a, which was terrible. But the setup with a minotaur stack taken on 111 actually worked out because of the lack of resources and only one stack for Shakti, along with the future prospects of the game.
Seeing the clear advantage of my opponent, I would gladly surrender on turn 123 rather than dragging it out to turn 2++.

I believe that in this case, a clear judging error has been made.
What needed to be done was to convey to Positiv that he was wrong. And the judges are unanimous on this issue (or at least the majority, as you voted in the Arbitration Committee – I'm not sure). But since a warning was issued to Positiv, it means that the decision that he was wrong has been made, explicitly or implicitly. And the responsibility (and the burden) for the situation he created should be placed squarely on him.
That is, since there is no time to resolve the situation caused by his inappropriate behavior, Positiv himself will have to resolve it urgently.
