I'm not so sure. They are now embodiments of the primordial magic of Ashan, as I understand it. Phoenixes from the third or fourth game could burn things down, yes. But if you design phoenixes based on the firebirds from Conflux, then that would be fine.

Also, the publishers said (3:45) that some factions simply cannot do without dragons.
And in another interview, they said that alternative champion units are an interesting idea (although they were not asked exactly about this). So, I wouldn't advise Necromancers to bury dragon bones too deep, and Demon worshippers to scatter the ashes of devils to the wind.
Kirins (according to some interpretations) are river unicorns, born in deep water and commanding celestial forces (rain, fog, hail, and the like). If you follow this concept, you could call them amphibians. Kirins are often depicted as similar to eastern dragons to give them grandeur, as they play a vital role in Japanese mythology. But snow maidens definitely don't resemble amphibians...

Kirins do indeed look very much like dragons, but the developers will always have the above excuse. Although, personally, I like regular kirins more than any dragons. But the sacred ones, not so much.

By the way, regarding phoenixes in Academy, that's how it was in Clash of Heroes.
