Divorce is the solution.

I'm also against divorces, but your idea will only encourage them further. Something happens => immediately go to court. Court => they'll argue even more, and then divorce is inevitable.

But it's much better not just to divorce from a not-so-beloved spouse, but also to get some satisfaction from fair retribution in the form of a prison sentence/fine.

Just to satisfy your ego? Is it really necessary?

The latter. A person should be responsible for their actions, and such indulgences don't contribute to that. It would be different if the crime was committed while intoxicated... Then the person really doesn't control themselves. But otherwise, I don't see why the punishment should be reduced. It's like... a creditor kills a debtor, and his sentence is reduced because the debtor owed him money.
