That's how it's done, Rimp knows. If you're sure that this person is actually alive, you send an ND (No Death) or cast a vote against them.

Judging by the characters, I personally wouldn't see any difference between killing one or the other mafia member.

There probably won't be any problems. For example, if Appa is killed, wouldn't you notice? :)

By the way, Zuko did the same thing in the series. He didn't know for sure if Aang was alive, but he suspected that Katara might have healed him, so he sent a mercenary to capture him, just in case.
