I don't think anyone would object to borrowing models, as long as you credit their source when you publish the mod.
Ideally, it would be even better to contact the authors. There are two points here: you not only ask for permission to use the models but also let them know about your existence. As a result, the model author might mention you somehow, which would increase the mod's popularity.

I want to transfer the world of Heroes into a real-time mode. To do this, I'm creating a mod for The Lord of the Rings: The Battle for Middle-earth 2. I'm taking models from Heroes 5: Tribes of the East. I want to immediately introduce factions like: Sanctuary, Fortress (Swamp), and Conflux. For this, I need models from the corresponding mods. Also, I need some units from the NFC project and models of some heroes. I'm not claiming authorship; I'll have to make some minor edits, at least for rigging. Question: from whom do I need to ask permission, and is it even necessary to ask permission to use these models?
P.S.: Many models belong to the user psatkha, and he often visits here, so I'm asking here.
I don't mind if the project is a fan project and, of course, not commercial!
By the way, do you animate them yourself for The Lord of the Rings: The Battle for Middle-earth 2?!
