According to the current rules, yes there is an avoidance, there is no talk of a tech rest, but this game (and not only this game) shows that the rules (like legislation) need to be constantly analyzed and amended.
On the other hand, this is a long-debated topic about using rests. Along the lines of "Chasing chocolate? Then be prepared for a surprise from the generator in the form of an autoloss."
