IMHO, the word "unfortunately" implies the answer "No," so a lie on the first question is impossible. A mafia member who is a town member and can kill is impossible, and a lie on the second question is impossible, so the cop is not a mafia member, but a peaceful member capable of killing, and a lie on the third question is possible: a peaceful town member who is not capable of killing.
