Apparently, the opponent didn't understand you, since they took a tech point. You can allow for informalities if there is mutual understanding with the opponent on this issue, but if there isn't, then demanding it is not comme il faut.
Simply acknowledging the permissibility of minor violations will lead to such a number of them... in this case, they say that the attacker could have checked the resistance, and didn't give the other player a chance to escape. To avoid such discussions, it's easier to follow even empty formalities.
