Because three out of five council members are unkillable, the fourth is immune to infection, and the fifth survives one assassination attempt. Also, the Mafia doesn't have many secondary night actions.
It's not a big deal to me. In this case, my vote expresses my position on your theory and my overall impression of you. If you hadn't suggested it, yes, it would be true. But there's no guarantee that Yashur isn't Mafia or a Cop, or Ursula. And it doesn't even matter. Anyone can cast a vote, and there's already a formal justification.
