For example, he wants to play with a built-up second level, but I don't, and how am I supposed to agree if the opp is stubborn :) How do I convince him not to tick the boxes? And this is a tournament game, the stakes are higher here, and if the game is in a team match, for instance, they are even higher. Right now there are no clear rules on which checkboxes to tick and which not, so sorry, but in tournaments I'll manage without it.

Because undoubtedly the situation changes on different maps, for different castles, and with different timers. But IMHO while one could still argue about replacing objects, when playing Inferno/Stronghold, refusing a built-up 2nd lvl is either hoping for luck or looking for overly complicated paths...
