Write – what is its relevance to the discussion? How does the old rule work, and how does the new one? And which is better/fairer in this situation?

What if it's not nonsense? Replaying the game? What if it's a club tournament? Or a mandatory continuation after the deadline for the round has passed?
Or a replay if there's still time. Or a draw. They really couldn't determine the strongest and got into a stalemate that affected the outcome of the game. No one has the moral right to win, and no one wants to lose. This is definitely not some insignificant battle of noobs. It's clear that this is a stalemate between main players.
If there's still time, replay. If not, a draw.
The whole question I'm raising is that there's no reason to award a loss to the attacker if the defender created a stalemate. All the defender has achieved is proving that they are not weaker. But they haven't proven that they are stronger. There's no reason to give them the victory.
