You are absolutely right about point 5 and the statement. However, it is incorrect to apply your case here. Put yourself in Vova's shoes – he spent his turns on something useful, possibly lost part of his army, and then it turns out that he cannot use it.
The only solution here is to save the game, and if the participants cannot unanimously agree on how to proceed, a judge needs to be involved.
