In general, this system of paying for a ban can only be justified to encourage players who are versatile and play different strategies, forcing players with a narrow specialization to pay for their chosen strategy. It's not meant to introduce unpredictability into the strategy selection process.

From this perspective, it makes sense to give the final choice of strategy to the player who pays for it.

This only makes sense when players specialize in the same thing, but in that case, the draw decides. There should be an element of chance in sports.

In this case, it's pointless to have any kind of ban when you can simply agree on a strategy beforehand.
