If I understand correctly, it was released. Although, some stores might have sold it earlier, but it's unlikely.

I bought it three hours ago, Jewel (or something like that), and launched the game. I entered the code and already managed to play the first mission and in multiplayer (duel). So, this is a licensed copy.
