Maybe he did prove it, but the non-mafia members translated his defense into Hos's words and wrote a note supposedly from him. However, if Gil were a mafia member trying to clear his name, wouldn't he have tried to downplay the scheme by shifting the defense to Hos? That's strange...
And Karen... something completely unbelievable is happening with her... Although, the last note seems to be true. Or maybe it's from other mafia members.
