Well, on the Nival forum, the penalty system isn't exactly great either, but it's still quite reasonable. After the release of 1.3, I wrote a lot of "nice things" there about the developers, and as a result, I got banned for 6 weeks for "repeated flaming." And even when my penalty level was 60% (I have no idea how it's calculated), I had already agreed with a moderator that I wouldn't cause any more trouble and hadn't written anything else, but half an hour later, some jerk moderator banned me. So, you have to be more careful with the penalties – to avoid being punished twice for the same message, but otherwise, the system works.
