They won't allow it. But you can use scrolls with earth spells of levels 4 and 5 without building a Guild.

I didn't quite understand who remained in which positions.

According to the actual rules of Vol, only Specialists at level 4 can use (and only on "neutrals") their special magic, given to them at birth. The rest of the magic, not from "birth," above level 3, Specialists use on a general basis, as described in the Rules.
That is, without fulfilling the conditions in the Rules, no Hero can use scrolls higher than level 3 (exceptions - Specialists at level 4 magic, if the found scroll matches the magic they have from "birth" and only on "neutrals").
Magic of level 3 and below can be used by all Heroes without any restrictions.
