Regarding the technical defeat: the issue isn't about the game rules or cheating. Everything is clear. Simply, from a technical standpoint, there is a full right to demand a technical victory (or perhaps not a full right; I didn't find this point in the rules), but from a human perspective... it's a personal matter for each individual...
