The possibility of importing models and animations into Heroes 5 exists; there is nothing that would limit your ability to create these models and animations, rather than stealing them from another game. Everything else is irrelevant.

Everything else you listed does not prevent you from creating your own models. You have a choice, and nothing puts you personally in a position of "either stolen or nothing."
As a community, we have brought ourselves to this point, but this is solely our mistake and a different story.
