I voted for the second option because I am strongly against unsportsmanlike behavior, which casts a shadow not only on the player but also on the tournament itself, its prestige, and on the organizers and their good name. Of course, it is not up to me to decide, but if such a situation occurred within a tournament that I oversee, it would be clear what I would do, but in any case, the decision rests solely with the organizers.
